Terms and Conditions of E.N.T.E.R. Online Membership and Services

Standard definitions

Platform: is the online service provided by E.N.T.E.R. GmbH at www.enter-network.eu
User: is any organisation or person who has a membership account
Content: is any information inputted by a user on the platform or streamed from external sources
Membership: means the registration of a project or an organisation on the online platform
Member: means the person who is registered


1. General

The company
E.N.T.E.R. GmbH is a limited company based in Graz, Austria (Austrian Register of Companies N°: FN423006v, VAT N°: ATU69012347), with the purpose of disseminating information about results and products of European funded projects throughout Europe to promote their sustainable use and benefits to EU citizens, as well as building strong networks of EU project organisations and working to support organisations in improving the quality of EU project delivery.

E.N.T.E.R. GmbH offers the following main services:
The online E.N.T.E.R. platform enables the effective dissemination of content concerning EU funded projects to a broad community of interested organisations and persons. Users of this network are entitled to use a range of different features offered on the online platform.
Please note that before E.N.T.E.R. GmbH can allow the dissemination of information about a project, it will undertake a check to ensure that the project is funded by an EC funding programme. A user may be requested to provide documentary evidence, such as a copy of an official document from the European funding body.


2. Membership of E.N.T.E.R. (project and organisation registration)

User eligibility
The service contract is between the user and E.N.T.E.R. GmbH. Persons registering for a service on behalf of their respective organisation have to be authorised to do so.

Free and paid for services
The offered services for members on the E.N.T.E.R. online platform (for project registration as well as for organisation registration) are free to use. No charges will be made for any of the services and opportunities.

Membership and EU Project Expert database entry contracts
Registrations for projects and/or organisations are valid for an unlimited period of time. On behalf of users, projects and/or organisations may be deleted at any time if so requested.

Activation of membership and database (project and/or organisation) entries
E.N.T.E.R. GmbH commits to activating membership accounts for projects and/or organisations after the online registration is completed. Upon activation, members will be informed immediately by email.

Refusal of an organisation’s membership entry
The quality management board of E.N.T.E.R. GmbH reserves the right to refuse a membership application or an application to register for a project and/or organisation without providing a reason.


3. Operation of membership accounts and use of the online platform

Setting up an account
In order to set up an account, users are required to complete their profile by providing mandatory information. A valid email address is required and a password is created at the sign-up stage. The email address is used for both for logging-in and for communication between E.N.T.E.R. and the user.
The user is responsible for the accuracy and quality of all information provided, and if any changes occur, the user is required to update their organisation’s data in their member’s account. E.N.T.E.R. GmbH is not responsible for any content that is provided by a user. Projects should, under normal circumstances, only be registered once, by one partner in a project group, generally the coordinator or main dissemination partner. If E.N.T.E.R. receives a request to register a project more than once, we will ask for clarification about the reason for this and E.N.T.E.R. GmbH maintains the right to refuse the project registration request.

Ownership of data
The user grants E.N.T.E.R. GmbH with the non-exclusive right to use content it provides. In addition, the user guarantees that they own all rights to the content and are legally authorised to register such content with the E.N.T.E.R. online platform.
The user guarantees that the content is not protected by the rights of third parties.
The user also guarantees that the use of the content in the context of the membership contract does not violate the rights of any third parties, and that any third parties have given their legal consent for the use of the content.

Disclosure of information to third parties
Users may not disclose any account log-in details or any information obtained directly as a result of membership of the platform to third parties without specific consent from E.N.T.E.R. GmbH.

All services provided by E.N.T.E.R. GmbH are exclusively for registered users only
Each registered user is responsible for the confidential use of content it has access to in the members’ area. In particular the commercial use, surrendering and onward transmission of data, information, content etc. from the members’ area is strictly forbidden. Every such misuse will result in the immediate termination of the respective member’s membership of the network, and could lead to a claim for compensation being made against the guilty member.

Indemnity against claims by third parties
The user releases E.N.T.E.R. GmbH from any liability in relation to claims by third parties, particularly in connection with any violations of copyrights, trademark rights and personal rights, which may occur due to the use of the E.N.T.E.R. platform by a user. Should a user be aware that a third party intends to undertake legal action the user must inform E.N.T.E.R. immediately. E.N.T.E.R. GmbH has the legal right to defend itself against any such third party claims, and the release from third party liability also includes the reimbursement by the user in question of any legal costs incurred (or expected to be incurred) during the course of asserting its legal rights.


4. Disclaimer

General disclaimer
Although maximum care will be taken in the presentation of all information and content, E.N.T.E.R. GmbH accepts no liability in terms of authenticity, accuracy, completeness or quality of the material contained on the website. E.N.T.E.R. GmbH is not liable for any damages resulting from the use or the inability to use information on the website. E.N.T.E.R. assumes no liability for the content of external links. The provider of the linked site alone shall be liable for illegal, inaccurate or incomplete information on his site or for damages incurred by the use or the inability to use information or by use of inaccurate or incomplete information of the provider’s website.

Disclaimer regarding the content
All contents on the E.N.T.E.R. platform are subject to change and without obligation. E.N.T.E.R. GmbH reserves the right to change, add to, delete or suspend the publication, either temporarily or permanently, of pages or the entire site without prior notice.


5. Privacy Policy and confidentiality

Privacy statement
Content provided by users will only be used in accordance with the purpose of the online E.N.T.E.R. platform as described in these terms and conditions and according to the legal framework (European General Data Protection Regulation).

Confidentiality of user content
All content concerning registered users will be treated with absolute confidentiality by E.N.T.E.R. GmbH both inside as well as outside of the network. The user has the following rights according to the European GDPR regulations:

All claims and requests regarding the data protection and storage may always be directed towards: office@enter-network.eu


6. Copyright

Any reproduction or use of texts, photographs or other material in other media, whether electronically or in other forms, is strictly forbidden without the express consent of E.N.T.E.R. GmbH.


7. Settlement of disputes

Failing amicable settlement, the Courts of Graz, Austria, shall have sole authority to rule on any dispute between the contracting parties in respect of this membership. The contract will be governed by the law of Austria.
